These terms govern the use of the services provided by Open Experience GmbH — from the Experience ID to the construction services.

What do these terms of use cover?
The terms of use of Open Experience GmbH govern how you use our services: you need a personal account, the Experience ID, which gives you access to all services enabled for you. They further govern your responsibility for access credentials and uploaded content, the liability framework for the provision of the services, and the final provisions. Our privacy policy additionally applies to the processing of personal data.
Experience ID
- Account and activationTo use our services, you need a personal account, the so-called Experience ID. You can create this account free of charge via the website openexperience.de or through some of the services. The Experience ID gives you access to all Open Experience services enabled for you. For some services, activation happens automatically or upon conclusion of a contract; for others, an administrator can grant you access.
- Your responsibility for your accessPlease protect your Experience ID with a strong password and change it regularly. You are responsible for all activity carried out with your Experience ID and must ensure that no other person knows or can use your password.
Use of the services of Open Experience GmbH
- Use at your own responsibilityAny use of the services of Open Experience GmbH is at your own responsibility and risk. Any liability of Open Experience GmbH for direct and indirect damage resulting from the use of the service is excluded. In particular, any liability for consequential claims is also excluded. This exclusion of liability does not apply where intent or gross negligence can be proven on the part of Open Experience GmbH.
- Availability and diligenceOpen Experience GmbH warrants that due care is applied in creating the services and that the generally accepted rules of technology are observed. Open Experience GmbH places great importance on the reliability of the services provided, which are accessible on the internet with as few and as short interruptions as possible. Nevertheless, outages due to maintenance work, line faults, server crashes, etc. cannot be ruled out. Claims for damages against Open Experience GmbH due to outages or malfunctions of the services are only possible where intent or gross negligence can be proven.
Data protection and protection of copyright
Open Experience GmbH is not responsible for content that you, as a user, publish on the internet by means of the services. In particular, Open Experience GmbH is not obliged to review such content for possible legal infringements. Should a third party assert claims against you for possible legal infringements resulting from the content of the services, you undertake to indemnify Open Experience GmbH against any liability.

Miscellaneous
- Product and service informationI hereby consent to Open Experience GmbH sending me regular product and service information by email. I am aware that I can revoke my consent at any time, free of charge and without giving reasons. My contact details may not be passed on to third parties.
- Severability clauseShould one or more provisions of this offering be or become legally invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced as quickly as possible by another provision that comes closest to the economic intent of the invalid provision. The same applies in the event of a gap in the offering.
